Independence, Kansas has created an entire article within its Code of Ordinances specifically for solar access regulations. The article authorizes the citizens of Independence to enter into solar easement agreements with other property owners. These easements shall establish the “solar skyspace” envelope within which it “shall be unlawful for the owner of real property to erect a building or structure or to allow a tree, shrub or other flora to case a shadow upon a solar collector.” The majority of the article is focused on regulations for these solar easements requiring applicants do things such as file for recordation of the easement and undergo application review whereby the zoning administrator will review the easement to determine if it satisfies the requirements of the Code of Ordinances.
